General Immigration FAQ's

What is the 90-day Rule?

A foreign national who engages in conduct inconsistent with their nonimmigrant status within a 90-day period of entering the U.S. may become inadmissible for the green card or even permanently barred from entering the US. For example, coming into the United States on a B1/B2 visa then applying for a green card within 90 days would violate the 90 day rule.

Authorized stay grants a nonimmigrant a period in which he/she can remain in the United States even though the individual may not be holding lawful status. This may occur for example, if your visa recently expired and you are given a grace period permitting you to stay in the United States. Unlawful presence is when a non-immigrant no longer has either lawful status or an authorized stay.

On March 29, 2023 USCIS released their policy manual update and clarified that “in instances where the last day of a period for filing a paper-based benefit request, such as the last day before a requestor’s or beneficiary’s birthday, or the last day of a qualifying period, falls on a Saturday, Sunday, or federal holiday, USCIS will consider the filing to be timely if received by the end of the next business day.”

This will be on a case-by-case basis. Certain exceptions permit adjustment of status to green card holders – even if you are out of status. You must meet certain criteria including specific time frames, lawful entry, and previous visa status.
